Fulton PD – July 13-19

Amber E. Dwyer of 209 Bunker Hill Rd., Oswego was charged at 6:00 p.m. July 13 with criminal tampering. Police allege that on July 2 at 801 W. Broadway, she poured a bottle of chewing tobacco spit onto another person’s vehicle.
Jolene M. Clark of 219 1/2 Buffalo St., Fulton was charged at 12:17 a.m. July 14 with unlawful imprisonment, harassment, petit larceny, endangering the welfare of a child and criminal mischief. Police allege that earlier in the evening at that address, Clark got into a fight with someone, breaking the person’s cell phone, grabbing the person by the face, biting the person’s cheek, pulling the person’s hair and choking the person. Police allege Clark pushed the person back onto a couch, refusing to let the person leave, later blocking the person’s path to the door. Police allege that during the fight, Clark pushed a child aside.
Robert L. Bort of 365 W. 3rd St., Fulton was charged with harassment at 9:45 a.m. July 14. Police allege that on May 27 at a location on Seneca St., Bort punched a person in the face.
Matthew D. Gifford of 30 W. 11th St., Fulton was charged with several counts of petit larceny and conspiracy at 2:00 p.m. July 14. Police allege he stole from Price Chopper on April 16 and 17, May 9, 11, 12, and 13 along with co-defendants Lori Firenze and Shellee Coant (Coant is not named in all of the dates charged). Gifford was also arrested on a bench warrant for failing to appear in court. Gifford is alleged to have stolen more than $1,980 in items from Price Chopper. The only items mentioned specifically were packages of lobster tails.
Mathew T. Pluff of 114 Division St. was arrested at 10:45 a.m. on a bench warrant from Fulton City Court for allegedly failing to pay a fine and surcharge of $220.
Kristi L. Maginn of 49 Chase Rd. was arrested at 1:35 p.m. on July 15 on a bench warrant from Fulton City Court for allegedly failing to pay a $270 fine.
Joshua A. Fredenburg of 106 S. 7th St. was charged with assault at 9:05 p.m. July 15 for allegedly punching a person at 524 Rochester St. above the eye, which caused a cut that required medical attention.
Gary W. Swan, II of 363 S. 3rd St., Fulton was charged at 11:51 p.m. July 15 with an open container code violation for having an open can of Coors Light in a public place.
Keith E. Chetney of 129 Flood Dr., Fulton; Daniel J. Woodard, Jr. of 3264 County Route 57, Oswego; and Shayne M. Clark of 30 W. 11th St., Fulton were charged at 1:08 p.m. July 13 with criminal mischief for allegedly damaging two city-owned picnic tables at Recreation Park, valued at $300.
Jonathan C. Loomis of 20 Country Ln., Fulton was arested on a bench warrant for allegedly failing to appear in Fulton City Court to answer a charge of disordely conduct for allegedly squealing his tires on May 20.
Charles E. Diffenbacher, Jr. of 474 W. 4th St., Fulton was charged at 2:34 a.m. July 17 with DWI, DWI with a blood alcohol level above 0.08%, no headlights on and drinking alcohol in a vehicle. Police allege that while driving along W. 1st St. S. near Pine St., the officer saw headlights were not turned on. An open can of Bug Light beer was seen in the vehicle and Diffenbacher allegedly took a blood alcohol test that showed his levels were above legal limits.
Eric M. Gardner of 1100 Emery St., Fulton was charged with disorderly conduct at 12:38 a.m. July 18. Police allege he was in the parking lot of the 300 building at that address and refused to quiet down and stop swearing when ordered by police to do so.
Nicole A. Avery of 521 Buffalo St., Fulton was arrested at 2:07 a.m. July 18 on a pair of bench warrants from Fulton City court alleging she failed to appear to answer a charge of obstructing governmental administration and criminal tampering from December 29, 2008 and alleging she failed to appear to answer charges of burglary, harassment and child endangerment from September 23, 2008.
Timothy L. Lunderman of 310 Utica St. was charged with disorderly conduct at 11:50 p.m. July 16. Police allege he swore during what they described as a yelling tirade in the presence of neighbors while outside his home. On July 18 at 11:12 p.m. he was arrested again, charged with criminal contempt and aggravated harassment for allegedly calling someone 10 times despite a judge’s order to have no contact with the person.
