OSWEGO, NY – Charges against two Oswego firefighters have been adjourned in contemplation of dismissal.
The pair was facing misdemeanor forgery charges in connection to an Oct. 3 incident.
Brian D. Conzone, 43, of 5568 State Route 104, Oswego, and Brooks M. Hourigan, 39, of 12 Hawley St., Oswego, were charged on Oct. 26 with third-degree forgery and second-degree falsifying business records.
According to police reports, the two firefighters allegedly signed a person’s name to the Oswego City ambulance service transport report.
They were arrested after an investigation determined that they had allegedly, unlawfully signed the name to an official business record on or about Oct. 3, according to the police report.
In City Court on Tuesday, Judge James Metcalf noted that the pair has been punished by the department – placed on 30-days unpaid leave.
Their attorney James Eby pointed out that there was “absolutely no personnel gain” for either firefighter as a result of their action. And, both men have no criminal history at all, he added.
“We can put this matter behind us as far as the criminal court’s concerned. But, you will still have to deal with the repercussions from the city,†the judge told the firefighters.
Conzone and Hourigan were surrounded in court by several of their brother firefighters.
None of them made any comments to the media present.
The pair is reportedly eligible to return to duty on Sunday.
They still face potential sanctions from the mayor’s office.
