FULTON, NY – Today (Nov. 2), the Fulton Police Department arrested Charles D. Fitzgerald, the owner of The 420 Emporium which is located at 105 E. Broadway in the city of Fulton.
He was arrested and charged with 47 counts of Criminal Possession of a Weapon in the Third Degree, which is a Class D Felony.
On Oct. 30, Fulton Police responded to a reported alarm at the store location.
On police arrival, a window in the front door was found smashed and the door was open.
Upon investigating the burglary, officers observed a large amount of “metal knuckles” in a display case, and which were available for sale.
Metal knuckles, under Section 265.02 of the NYS Penal Law, are considered a deadly weapon and are illegal to possess.
Officers recovered 47 sets of metal knuckles from the business.
Further investigation found that Fitzgerald had previously been convicted of crime in New York State, which makes the charge against him a Class D Felony.
Fitzgerald turned himself in to Fulton Police at 8 a.m. today.
He was arraigned by Fulton City Court Judge Spencer Ludington and released on $2,500 bail.
He is scheduled to return to Fulton City Court on 12/21/2011 at 9 a.m.
