Tabitha A. Regan of 1100 Emery St., Apt. B-4,  is facing charges of second-degree rape and endangering the welfare of a child. Regan admitted to having sexual intercourse with the boy at his home Aug. 29.

Regan was slated to make a court appearance this week in Fulton City Court.

“Miss Regan’s case was adjourned to Jan. 14,” Chief Court Clerk Maureen Ball said.

In statements offered to police by Regan and the victim, both confirmed that the incident and said that it was consensual. Each said the other initiated the act, however.

Regan admitted that she knew the victim was too young. At 13 years old, the victim is four years younger than the legal age of consent in New York state.
