Fulton Man Accepts Plea Deal for Manufacturing Meth In Presence Of Children

FULTON, NY – A Fulton man arrested in December 2015 for manufacturing methamphetamine in his home with children present [1]has plead guilty to one felony charge and three misdemeanor charges.

Tyko J. Delaney Sr. was arrested along with four others by Fulton City Police as well as members of the New York State Police and the Oswego County Drug Task Force for possessing equipment and materials to manufacture methamphetamine, which was also found in the residence at 7 N. Seventh St. in the city of Fulton.

A police report indicated that there were six children present in the residence at the time the search warrant was executed.

Originally, Delaney was charged with unlawful manufacture of methamphetamine in the second degree, a class C Felony; unlawful manufacture of methamphetamine in the third degree, a class D Felony; conspiracy in the fourth degree, a class E Felony; three counts of endangering the welfare of a child, a class A misdemeanor; and criminal possession of a controlled substance in the seventh degree, a class A misdemeanor.

In a court appearance in front of Oswego County Court Judge Donald Todd on Wednesday (March 2), Delaney, alongside his attorney Lonnie Dorsey, plead guilty to the charges of unlawful manufacturing of methamphetamine in the third degree and three counts of endangering the welfare of a child.

By pleading guilty, Delaney waived his right to indictment and trial rights, including the right to appeal the sentencing set forth by the judge.

In such plea deal, Delaney will face a sentence certain of four years determinate in state prison with two years of post-release supervision.

Delaney is serving one-year sentences for each count of endangering the welfare of a child to run concurrent with his four-year sentencing.

Judge Todd explained that with this sentence certain, Delaney will face no more and no less than four years with no requests to be made by either party for reduced or extended sentencing.

Delaney acknowledged and admitted to possessing at least two of several categories of materials needed to produce methamphetamine with the intent to use or produce methamphetamine while in the presence of children ages five, three and one.

Despite a request by Dorsey to be released on electronic monitoring while awaiting his sentencing to get his personal affairs in order, Judge Todd remanded Delaney without bail based on his second felony offender status.

Delaney is scheduled to be sentenced on April 11.
