Developer’s Lawsuit ‘has no merit or legal basis’

OSWEGO, NY – At Monday night’s Common Council meeting, Mayor Tom Gillen, on behalf of the Common Council, reiterated the city’s policy to refrain from discussing pending litigation; regarding the former Cahill / Coleman building.

Mayor Gillen reported today (Nov. 12) that the city has received an opinion from its counsel, Bond, Schoeneck & King, PLLC, that the lawsuit commenced by Thomas Millar has no merit or legal basis.

The city is vigorously defending the lawsuit, which is wrongfully interfering with and delaying the redevelopment of this historic building and the related grounds, in accordance with the Common Council’s enabling resolution, according to ther Mayor’s Office.

While the litigation is pending, the city is working with expert structural engineers, who have recommended a course of action to arrest further deterioration of the building.

The Common Council has unanimously authorized Mayor Gillen to enter into an agreement with a roofing contractor to fully and specifically tarp the roof of the building, in accordance with the advice of the engineers.
