OSWEGO — The Administrative Services Committee put four Oswego business owners on notice of possible lawsuits unless they repay (between $11,000 and $65,000 each) overdue Community Development Office loans.
At its meeting Monday night, the committee gave a favorable recommendation to City Attorney Kevin Caraccioli’s request to take legal action against the four.

“They owe approximately $160,000, which needs to be accounted for. This is an attempt to collect what is owed the city of Oswego,” he told the committee. “I’m asking for your support to take legal action.”
The borrowers and business involved, including the amounts due, are as follows:
• Historic Woodruff Block, LLC (Tom Millar, Principal), 17 W. Cayuga St. – $65,000+
• Alice Davis, Alice’s Scoops (Ice Cream Trailer), 241 Paddy Lake Road – $52,863
• Dayne Cory & Theresa Brase, (Mild 2XXX Wild), 194 Water St. – $29,221.36
• James V. Tesoriero III, 167 W. First St. (façade repairs) – $11,162.88
The attorney said he hopes to recoup a large portion of the outstanding funds.
“I can’t guarantee we’ll get it all. In fact, I can almost guarantee that we won’t,” he said. “But we’re going to make the effort to do that.”
In Other Action:
Mayor Billy Barlow requested a budget amendment to the Water Department’s budget in the amount of $20,660.
The funding is needed, he said, to cover the water plant’s needs for the next couple of months.
Among the needs are new chlorine pumps ($7,500), engineering for the Riley booster station ($3,000), Duer Street pump bearings ($4,000) and chlorine pump rebuild kits ($3,000).
Fire Chief Randall Griffin requested permission to accept the donation of a Gauch Washing Machine with 6” steel base from the Firefighter’s Cancer Foundation of New York.
The machine is worth approximately $7,000 and will help remove potentially cancer causing substances that get into the gear.
As part of the deal, OFD will use the machine to decontaminate Fulton Fire Department’s gear as well.
Justin Rudgick, Community Development Director, received a request from Trinity Catholic School regarding the Third Annual Trinity Turkey Trot Family Fun Run/Walk on November 19 at 12:30 p.m. They also requested a police escort.
The Engineering Department requested approval of:
• Change Order No. 1 for the general contract with W.D. Malone Trucking and Excavating, Inc. for the West Side Sanitary Sewer Rehabilitation – Area 2 in the amount of $0 for extra work for unforeseen conditions.
• Change Order No. 1 for additional dye testing to be performed under the Oswego Harbor Brook SSES to Confirm Illicit Discharge Connections Project in the amount of $10,400 with CH2M Hill Engineers.
• Change Order No. 6 for the general contract with Marcellus Construction Co. for the Combined Sewer Separation-Second 25% in the amount of $0 for additional work for unforeseen conditions.
• Change Order No. 7 decreasing the construction contract with Marcellus Construction Co. for the Combined Sewer Separation- Second 25% in the amount of $102,085.59 for the actual unit price pay item quantities versus the original contract estimates, upon substantial completion of the project, and the subsequent change in the overall contract amount. The dollar amount of the contract would decrease from $2,960,000 to $2,857,914,41.
And, the Physical Services Committee OK’d a request from Melissa Murphy, property owner of a single-family dwelling at 40 W. Ninth St., located in the Third Ward, for use of public space 19’x19’ for a new two-car paved parking area together with a new 12’x19’ paved apron between the sidewalk and property line fronting West Ninth Street.
All of the requests will be discussed at the October 23 Common Council meeting.
