Oswego Council To Conduct Public Hearings


OSWEGO, NY – At its meeting this week, the Common Council scheduled a trio of public hearings.

The first will be Nov. 28 at 7 p.m. in the Council Chambers regarding a proposed local law with respect to the city budget.

In 2002, the council amended the deadlines for the submission and passing of the annual budget and required a public referendum for tax increases of 5 percent or more than the previous year’s tax rate.

Changes at the state level have made the 5 percent figure moot. Therefore, the city is proposing to change the schedule back to the mayor presenting the proposed budget to the council no later than Dec. 1 and the council shall have until Dec. 31 (or the next business day) to approve the budget.

The second public hearing deals with the Brittany Hill Planned Development District.

An amendment to the Brittany Hill Planned Development for properties addressed at Lot J-213 and Lot J-215 Christopher Circle, to allow for a single-family dwelling of approximately 2,000 square feet received a favorable recommendation at last month’s Planning Board.

According to the city’s zoning ordinance, a public hearing is required for each phase of the district. The council set Nov. 28 at 7:05 p.m. in the Council Chambers for the public hearing.

The third public hearing is in regards to the Port City’s proposed tree ordinance. It is a requirement of becoming a Tree City USA.

The hearing will be Nov. 28 at 7:10 p.m. in the Council Chambers.

The council also authorized the mayor to sign the lease agreement with Harbor Festivals, Inc. The new lease would be for two years, Jan. 1, 2012, through Dec. 31, 2013.

Deborah Coad, city chamberlain, was authorized to complete generally accepted accounting procedures to close the 2011 financial records of the city as necessary.

Fire Chief Jeff McCrobie was authorized to accept two computers and computer equipment that have been offered as a donation to the department.

The council approved the low bid submitted by Butler Disposal Systems ($29,940) to pick up and dispose of trash and recyclable materials from city-owned facilities and various city streets and parks.

The term of the contract would be from Jan. 1, 2012, through Dec. 31, 2013, and can be extended an additional year at the same contract price if mutually agreed upon by both parties.

Councilors also rescinded Resolution No. 242 of 2011 for Matthew Brancato as he has not agreed to provide an easement on his property.

Tony Leotta, city engineer requested that a new resolution be adopted stating that Brancato will maintain the existing manhole in the storm sewer or shall construct a new manhole in the floor of the garage and shall provide the city access to the manhole for maintenance or repair of the storm sewer line. Also, the city shall have no liability for any damages to the garage that could be caused by operations or maintenance of the storm sewer line.

That resolution was approved 7-0.

Barbara Sugar, city clerk, was authorized to transfer $2,000 from Miscellaneous Expenses Account No. A.1410.460 into Contracted Services Account No. A.1410.440.

This transfer is necessary due to increased costs to General Code for supplements to our Code Books and increased printing supply costs due to the City Clerk’s Office now being responsible for the mailing of dog license renewals.

The chamberlain was authorized to transfer funds in the computer department: $1,200 from A.1680.0200 Equipment to A.1680.0410 Materials and Supplies and $1,300 from A.1680.0450 Fees for Service to A.1680.0410 Materials and Supplies.

Mike Smith, DPW commissioner, was authorized to make transfers totaling more than $79,147 into various different accounts in his department.

A request for a zone change from Furlong Properties, contract purchaser of real property located in the Fifth Ward at 218 W. Eighth St., from an R-3 Residential District to a B-l Neighborhood Business District was referred to the Planning Board for an advisory opinion, pursuant to the provisions of the Code of the City of Oswego, Chapter 280, Zoning Ordinance, Section 280-93, Subsection C.

Councilors approved a request by Janet Musacchio for use of public space in order to install a new handicap lift.

It would be created within her home’s porch, in public space, fronting her residence at 121 E. Third St. This is an emergency request due to the handicap condition of her husband, Bill.

The city engineer said the Common Council is the lead agency for the West Side Sanitary Sewer System Rehabilitation – Area 1, EFC No. C7-6344-19-04.

The SEQR Negative Declaration must be acknowledged and approved by Common Council Resolution. The council voted 7-0 to accept the negative declaration.
