Oswego County Sheriff’s Office 09/29/2008


On 9/25/08 at 9:00 a.m., Daniel M. Swank, 30, of 29 Wilson Road, Hastings, NY, was served with a Criminal Summons charging him with Harassment, Second Degree, a violation, stemming from an incident that occurred on 9/10/08 outside of his residence during which he allegedly grabbed a female victim by the throat and choked her, then punched her in the face and pulled her hair.  Mr. Swank is scheduled to answer the charge before Town of Hastings Court on 10/01/08.

On 9/25/08 at 7:34 p.m., Terrilee Johnson, 43, of 5943 North Syracuse, NY was operating a 2005 Chevrolet on I-81 south bound in the Town of Hastings when she reportedly swerved to miss a crossing deer loosing control causing the vehicle to go off the west side of the road, overturn and strike some trees before coming to rest on it’s roof.  Ms. Johnson was taken by helicopter to Upstate Medical Center in Syracuse.

On 9/26/08, Gerald T. Hall, 29, of 75 E. 10th St., Apt. 1, Oswego, NY, was arrested at 10:51 a.m. at the Oswego County Correctional Facility for Petit Larceny, a class A misdemeanor.  Mr. Hall was released on an appearance ticket returnable to Town of Volney Court o 9/29/08.  He is accused of stealing shovels from the Northern Concrete Hardware Store on 9/03/08.

On 9/26/08 at 3:35 p.m., a 16 year old male residing in the Town of Mexico was arrested for Endangering the Welfare of a Child, a class A misdemeanor, and Sexual Abuse, Third Degree, and Public Lewdness, both class B misdemeanors, after being accused of hitting a female student in the face with his penis after asking her if she had ever had a “mushroom stamp.”  The incident occurred while riding on a school bus in the presence of other students.  The youth was released on appearance tickets and is scheduled to answer the charges before Town of Mexico Court on 10/07/08.

On 9/26/08, Donald R. Pomatto, 42, of 22 Somers Drive, Fulton, NY, was arrested at 10:55 p.m. for Driving While Intoxicated, Driving With .08 of One Percent or More of Alcohol, and Aggravated Unlicensed Operation, First Degree, all class E felonies; Helmet Required (motorcycle); and Lighting Not in Use (headlights) following a traffic stop initiated on CR 8 near CR 3 in the Town of Granby.  Mr. Pomatto was arraigned before the Hon. Edwin Winkworth, Town of Granby Court, and remanded to the Oswego County Correctional Facility in lieu of $2,000 cash bail or $4,000 bail bond.  He is scheduled to return to Town of Granby Court on 9/29/08.

On 9/26/08, Lisa M. Millard, 50, of 13 Green Acres Dr. Apt #4, Central Square, NY was arrested for Operating a MV with Suspended Registration and No License after the LPR unit registered a hit on a suspended registration which initiated a traffic stop on Green Acres Drive in the V/O Central Square..  Ms. Millard was issued UTT’s, returnable to the V/O Central Square Court on 10/15/08.

On 9/26/08 at 2:30 a.m., David Hayes, 20, of 330 Rathburn Rd., Fulton, NY was operating a 2003 Chevrolet south on Chapel Rd. in the Town of Oswego when reportedly a deer ran out in front of him and while swerving to miss the deer, went off the road damaging a fence at 85 Chapel Rd. and overturned.  Mr. Hayes was issued a ticket for Leaving the Scene of a MVA .  Unsafe speed seems to have been a contributing factor.

On 9/27/08 at 7:58 p.m., Charles F. Hartmann, 70, of 63 Kelly Drive, Central Square, NY, was arrested for felony Driving While Intoxicated, felony Driving With .08 of One Percent or More of Alcohol, Reckless Driving, and Failed to Use Designated Lane, following the investigation into a property damage accident during which he allegedly drove his 2005 Jeep through a residence at 30 Kelly Drive, Town of Hastings.  The vehicle reportedly entered the east side of the residence and exited through the south side bedroom wall..  One of the residents had just gotten off her bed and exited the bedroom when the crash occurred.  When the vehicle was removed by a tow truck, the bed was found underneath the vehicle.  Mr. Hartmann was arraigned before the Hon. Maureen Stetson, Village of Central Square Court, and remanded to the Oswego County Correctional Facility in lieu of $2,500 cash bail or $5,000 bail bond.  He is scheduled to appear before Town of Hastings Court on 10/01/08 to answer the charges.

On 9/28/08, Derek C. Gamble, 26, of 104 Franklin St. Apt. #4, Brownville, NY was arrested at 7:00 p.m. based on a Family Court Warrant issued by the Hon James Metcalf charging him with violating Article IV of the Family Court Act (failure to pay support).  Mr. Gamble was arraigned in the Town of Scriba Court and remanded to the Oswego County Correctional Facility in lieu of $2500.00 cash or $5000.00 bond.

On 9/28/08 at 11:46 p.m., Anthony S. Elkin, 20, of Silk Rd. Bldg #728, Fulton, NY was arrested for Criminal Tampering, 3rd degree, a class B misdemeanor stemming from the investigation into an incident in which a vehicle was reportedly going down the road as paintballs were being shot out of it at houses in the Town of Volney.  Also arrested for Criminal Tampering in this incident, was Josh J. Johnson, 21, of CR 57 Bldg # 1608, Fulton, NY.  Both individuals were released on appearance tickets, returnable to the Town of Volney Court on 10/13/08.
