Oswego County Sheriff’s Office 10/27/2008


On 10/24/08, Michellyn F. Barbernitz, 28, of 1185 Mulberry, Gardner, Ks., was operating a 2000 Oldsmobile northbound on CR 7 in the Town of Oswego at 9:12 a.m. when, while slowing in traffic for a vehicle that was turning ahead of her, her vehicle was rear-ended by a northbound 1996 Chevrolet Suburban driven by Jonathan C. Lombardo, 22, of 702 CR 25, Oswego, NY.  The incident occurred 3/10 of a mile north of Gardenier Road.  Mr. Lombardo was ticketed for Following Too Closely.

On 10/24/08 at 4:52 p.m., Jessica R. Wood, 22, of 10 B Larnard Road, Pennellville, NY, and Casey M. Trumble, 22, of 4 Franklin Drive, Pennellville, NY, were each arrested for Petit Larceny and Endangering the Welfare of a Child, both class A misdemeanors, as well as Conspiracy, Sixth Degree, a class B misdemeanor, after being accused of concealing items, then passing the final point of sale while shopping at the Wal-Mart Super Center located in the Town of Granby, all while in the presence of a minor.  Both women were released on appearance tickets returnable to Town of Granby Court on 11/03/08.

On 10/24/08, James A.Stoddard, 20, of 30 Orangewood Drive, Liverpool, NY, was operating a 2005 Chevrolet southbound on New Street in the Town of Oswego at 5:56 p.m. when he reportedly pulled out onto SR 104 into the path of a westbound 1999 Nissan driven by Katherine VanKessel, 18, of 12 Horseshoe Road, Millbrook, NY.  Ms. VanKessel and four of her passengers, Jessica L. Spencer, 18, Michael A. Coulehan, 18, and Danielle M. Urbaniak, 19, were all transported by ambulance to the Oswego Hospital.  Failure to yield the right of way appears to have been a contributing factor in the incident.

On 10/24/08 at 9:18 p.m., Seth A. Comely, 20, of 103 Fraser Rd., Mexico, NY, was charged with Unregistered ATV, Disobeying the Lawful Order of a Police Officer, Unlawful Operation on Public Highways, Speeding, and No Protective Helmet, following a traffic stop after he was observed operating an ATV westbound on Main Street near Scenic Avenue in the Village of Mexico.  Reportedly, initial efforts to have Mr. Comely stop were ignored with a pursuit that took him through the Town of Mexico and finally into an apple orchard before being apprehended on Halsey Road just off Tubbs.  Mr. Comely was arraigned before the Hon. James Gracey, Town of Mexico Court, where he was released on his own recognizance.  He is scheduled to return to court on 11/18/08.

On 10/25/08 at 12:48 a.m., Michael C. Hutchinson, 34, of 24 Pershing Drive, Fulton, NY, was detained by a member of the Fulton Police Department and turned over to a member of the Oswego County Sheriff’s Office who arrested Mr. Hutchinson based on a Family Court Warrant issued by the Hon. David J. Roman, Oswego County Family Court, charging him with violating Article IV of the Family Court Act, (failure to pay support).  Mr. Hutchinson was arraigned before Town of Scriba Court and remanded to the Oswego County Correctional Facility in lieu of $2,500 cash bail or $5,000 bail bond.  He is scheduled to appear before Oswego County Family Court on 10/27/08.

On 10/25/08 at 4:33 a.m., Kristin L. LaBeef, 32, of 2013 CR 8, Oswego, NY, was arrested for Driving While Intoxicated; Driving With .08 of One Percent or More of Alcohol; Failure to Keep Right; Aggravated Unlicensed Operation, Third Degree; and Criminal Possession of a Controlled Substance, Seventh Degree, a class A misdemeanor, following a traffic stop on Cayuga Street in the Village of Hannibal.  Ms. LaBeef was released on appearance tickets returnable to Town of Hannibal Court on 11/11/08.  Ms. LaBeef was first observed crossing the center line, entering the oncoming lane of traffic, while making a turn from Oswego Street onto SR 3.  She was then observed going off the roadway nearly striking a curb while making a left turn onto Cayuga Street.

On 10/25/08 at 5:23 a.m., Andrew C. Balcom, 20, of 21 James St., Pulaski, NY, was arrested for Driving While Intoxicated, Driving With .08 of One Percent or More of Alcohol, and Crossed Hazardous Road Markings, following the investigation into a one-car motor vehicle accident that occurred on CR 26 in the Town of Amboy.  He is scheduled to answer the charges before Town of Amboy Court on 11/25/08.  Mr. Balcom was reportedly driving his 1998 Nissan eastbound on CR 26 when he lost control ½ mile east of Coan Pond Road causing the vehicle to go off the south side of the roadway, overturning several times, going down an embankment, before coming to rest on its wheels facing the road about 50 feet from the road.

On 10/25/08 at 9:30 a.m., Brian M. Sandler, 34, of 284 Durbin Rd., Hannibal, NY, was served a Criminal Summons issued by Town of Hannibal Court charging him with Harassment, Second Degree, a violation, stemming from an incident that occurred on 9/20/08 when he allegedly punched a male victim in the side of his head while at the Hannibal Quick Mart.  Mr. Sandler is scheduled to answer the charge before Town of Hannibal Court on 10/28/08.

On 10/25/08, Erica L. Wallace, 19, of 5825 Bartell Road, Brewerton, NY, was operating a 2003 Jeep Suburban westbound on CR 37 at 6:40 p.m. when she reportedly lost control of the vehicle one mile west of Gildner Road causing it to go off the road and strike several trees before coming to rest.  Outside car distraction appears to have been a contributing factor with Ms. Wallace reportedly attempting to get a leaf off the vehicle’s window.

On 10/25/08 at 9:26 p.m., Kevin M. Zaleski, 31, of 681 CR 54, Pennellville, NY, was arrested for Criminal Possession of a Weapon, Fourth Degree, a class A misdemeanor, after being accused of being in possession of a shot gun, which was considered a crime as it is a crime for a convicted felon to possess a firearm, even if it does not belong to the felon.  Mr. Zaleski was released on an appearance ticket returnable to Town of Schroeppel Court on 11/05/08.

On 10/26/08 at 1:07 p.m., Brandon K. Boring, 24, of 75 Barker Rd., Hastings, NY, was arrested for Criminal Mischief, Fourth Degree, a class A misdemeanor, stemming from an incident that occurred on 8/17/08 during which he was accused of causing damage to a vehicle by smashing out the driver’s side window, breaking an outside mirror, and denting the vehicle’s hood, acts that took place outside of a Town of Hastings bar.  Mr. Boring was released on an appearance ticket and is scheduled to answer the charge before Town of Hastings Court on 11/19/08.

On 10/26/08 at 10:08 p.m., Harry M. Shuler, 42, of 1237 CR 85, Hannibal, NY, was charged with Aggravated Unlicensed Operation, Second Degree (11 suspensions, 6 scoffs on 4 different dates), and Inadequate Plate Lamps, following a traffic stop at the intersection of Fulton Avenue and Oswego Street in the Village of Hannibal.  Mr. Shuler was arraigned before the Hon. Eugene Hafner, Town of Hannibal Court, and remanded to the Oswego County Correctional Facility in lieu of $500 cash bail or $1,000 bail bond.  He is scheduled to return to court on 11/18/08.
