Vehicle Pursuit Leads To Arrest Of Man With Felony Arrest Warrant And Additional Felony Charges

FULTON – On May 7th, 2024, at approximately 6:45 pm, Fulton Police attempted to stop a gray Chrysler 200 in the area of River Glen Dr. and State Route 481 in the City of Fulton as the driver was identified as 31 year old Timothy Benway. Benway was wanted by the Fulton Police Department on a Felony Arrest Warrant for Grand Larceny, a misdemeanor Arrest Warrant for Aggravated Unlicensed Operator Third Degree as well as two additional misdemeanor Bench Warrants. As a Fulton Police Officer attempted to initiate a traffic stop by activating his emergency lights and sirens, Benway fled southbound at a high rate of speed on State Route 481 in an attempt to elude police. As officers continued to attempt to stop Benway, he drove at speeds of approximately 125 MPH. During the course of the pursuit, Benway was passing motorists on the right while crossing over the white fog line while continuing to attempt to get away from pursuing police. Benway eventually exited the highway and entered the Village of Phoenix where pursuing officers terminated the pursuit. The vehicle was eventually located unoccupied on Barnes St. in the Village of Phoenix.

Police obtained information that Benway was at a residence in the Town of Schroeppel on Oswego River Rd. With assistance from the Oswego County Sheriff’s Office, an Investigator from the Oswego County District Attorney’s Office, New York State Police and Village of Phoenix Police Department a search warrant was conducted at the residence where Benway was eventually located within a wall of the structure by Oswego County Sheriff’s Department K-9 and taken into custody.

Benway was charged with the following for the vehicle pursuit: Reckless Endangerment First Degree a Class D Felony, Reckless Driving, Aggravated Unlicensed Operator Second Degree, Aggravated Unlicensed Operator Third Degree all traffic misdemeanors, Fleeing an Officer in. a Motor Vehicle Thi.rd Degree a Class A. Misdemeanor, as well as unlicensed operator, speed in zone, failure to obey a police officer, crossing road hazard markings all traffic violations.

Benway was also arrested on a pending case out of the City of Fulton Police Department for Criminal Contempt First Degree a Class E Felony, and Criminal Obstruction of Breathing a Class A Misdemeanor.

At the location in the Town of Schroeppel, Benway was charged with Resisting Arrest and Criminal Possession of a Controlled Substance Seventh Degree both Class A Misdemeanors.

On May 8th at Centralized Arraignment, Benway was arraigned by the Honorable Timothy Kirwan on the previously mentioned three new cases as well as the two arrest warrants and two bench warrants. Benway was remanded to the Oswego County Jail on $1,000 cash bail/ $5,000 bail bond/ $10,000 surety bond for each case involved.
