OSWEGO, NY – This week, Oswego County Court Judge Walt Hafner dismissed the felonies against Richard, 28, and Katherine Graham, 26, the Oswego Town couple who were charged with starving their then 14-month-old twins.
The two felony counts of assault and reckless endangerment against the couple were dismissed; but, two misdemeanor counts each of assault, endangering the welfare of a child and reckless endangerment weren’t.
The evidence against the Furniss Station Road couple was insufficient, according to the judge’s ruling.
Now, the district attorney’s office now has until May 10 to decide how it will proceed with the case.
The Grahams are free on $5,000 bail.
They still have custody of four of their children while the twins, now 23 months old, are in foster care.
