Arrests Made in Larceny From Former Nestles Plant

Fulton Police arrested two subjects attempting to steal scrap metal from the former Nestle building located at 555 S. Fourth St in Fulton.

Officers were aware of the activity after receiving a report the previous evening that someone had stolen a large amount of copper pipe from the property.

On Friday, Sept. 13, at about 12:15 a.m., officers located two men inside a fenced in area on the property.

Through the investigation, it was found that the two men were allegedly attempting to steal scrap copper pipe from large pieces of machinery that remain on the property.

The men also possessed tools that were being used to facilitate their actions, police said.

Arrested were: Jeremy R. Ware, 28, of 337 Rathburn Road, Fulton. He was charged with: Petit Larceny, Class A Misdemeanor; Possession of Burglars Tools, Class A Misdemeanor; Criminal Trespass 3rd, Class B Misdemeanor; and Conspiracy 6th, Class B Misdemeanor.

Timothy F. Gioia, 31, of 368 Furniss Road, Oswego. He was charged with: Petit Larceny, Class A Misdemeanor; Possession of Burglars Tools, Class A Misdemeanor; Criminal Possession of a Controlled Substance 7th, Class A Misdemeanor; Criminal Trespass 3rd, Class B Misdemeanor; and Conspiracy 6th, Class B Misdemeanor.

Both subjects were held in Fulton Police lockup until their arraignments.

They were arraigned by Fulton City Court Judge Hawthorne on Sept. 13 and released on their own recognizance.

Ware is to return to Fulton City Court on 10/9/2013.

Gioia is to return on 10/23/2013.
