Local Woman Accused of Rape

FULTON, NY – An 18-year-old Fulton woman has admitted to having sexual intercourse with a 13-year-old boy in his home last month. Now, Tabitha A. Regan of 1100 Emery St., Apt. B-4,  is facing charges of second-degree rape and endangering the welfare of a child.

Statements offered by both Regan and the victim show similar circumstances with a different initiator.

Both Regan and the boy say that they met over the summer at Rowlee Beach in Fulton. Both say they engaged in consensual sex in his bedroom Aug. 29. In her statement, Regan told police that the victim was “bugging” her to have sex. The victim reports that Regan initiated the act.

Regan said she believed the victim to be between 14 and 16 years old but admitted to police that she knew he was too young. She said she’s been doing things out of character for several months.

“This is the first time I have ever had sex with someone that young,” she added. “I knew (the victim) was too young to have sex with, but he kept bugging me. … I did it to shut him up.”

In his statement, the victim told police that Regan came to his house in the evening on Aug. 29 while he was watching television. He said his mother was asleep on the couch at the time.

The victim said he went upstairs to use the bathroom and said Regan followed. He said she knocked on the door as he was finishing washing his hands and told him to go into his bedroom.

“I asked her why she was there and she said because she wanted me,” he said. He said Regan began to touch and kiss him before she undressed herself and took off his pants.

“After we had sex, she didn’t really say anything,” he said. “She got dressed and left. … My mother never woke up during this and no one else was around. This was the only time we had sex.”

The victim said he was not forced and wanted to have sexual intercourse with Regan. At 13 years old, the boy is four years younger than the legal age of consent in New York state.
