Grand Jury Returns Reckless Endangerment Charge

OSWEGO, NY – Jessica Burger, the woman accused of firing shots at another woman’s car after a dispute at her home, has been indicted.

Burger, 27, was arrested May 5 and charged with two counts of second-degree attempted murder and six counts of first-degree reckless endangerment. Police said Jennifer Gravatt woke Burger at her home at 33 Mill St., Hannibal, during the early morning hours of May 5. The two started arguing over Burger’s fiancé, Levi Stone.

Burger told Gravatt to leave, which she did. Moments later, police said Burger grabbed a Mossberg 20-gauge shotgun and walked outside looking for Gravatt and Stone.

Outside, Gravatt got into the driver’s seat of her two-door 1996 Saturn and Stone got into the passenger’s seat. Burger reportedly fired a shot into the air before walking to the car and striking the front passenger-side window of the car with the shotgun, breaking the butt of the gun.

As Gravatt tried to leave the property, police said Burger fired a slug at the vehicle, which went through the driver’s side back window and exited through the passenger‘s side back window, continuing on into a neighbor‘s home. Another shot went into the wooded area behind her home, police said.

Stone exited the vehicle after the first shot was fired. Gravatt drove to a nearby business to call 911.

Assistant District Attorney Mary Rain said an Oswego County grand jury returned one count of first-degree reckless endangerment against Burger earlier this month.

“We are waiting for a judge so she can be arraigned on the charge,” Rain said Tuesday.

Burger originally appeared for arraignment Tuesday in Oswego County Court. The proceeding was postponed, however, after Oswego County Court Judge Walter Hafner Jr., recused himself from the case.  The matter has been referred to Fifth District Administrative Judge James C. Tormey, who will select a judge.
