Higgins Case Moved To December

FULTON, NY – The Fulton code enforcement officer who was arrested Nov. 3 for allegedly skimming money she received for rental permits and contractor licenses will return to court next month.

Rita Higgins, 57, of West Fourth Street South, Fulton, faces four counts each of first-degree tampering with public records, a class-D felony, and petit larceny, a class-A misdemeanor. She was scheduled to make an appearance in Fulton City Court Friday before Judge James Metcalf.

Metcalf was assigned to the case because Fulton City Court Judge Spencer Ludington recused himself shortly after Higgins’ arrest, according to Chief Court Clerk Maureen Ball.

Ball noted that the Higgins did not appear in court Friday. Rather, the case was adjourned to Dec. 12. Higgins was released on her own recognizance after her arraignment Nov. 3. missing or outdated ad config
