OSWEGO, NY – A Huntley Hearing will be held next month to consider whether statements made by a local businessman can be used at his trial.
Anthony M. Pauldine, 51, of 190 Fifth Ave., Oswego, appeared in Oswego City Court on Thursday.
He was charged Oct. 26, 2009, with third-degree sexual abuse (a class B misdemeanor) and endangering the welfare of a child (a class A misdemeanor).
Pauldine was arrested after an investigation determined that he had allegedly subjected a boy, who was less than 17 years of age, to sexual contact on or about Oct. 18, 2009, police said.
He was arraigned and then released on his own recognizance.
Assistant District Attorney Donald Todd said Thursday that Pauldine is seeking to suppress statements the prosecution wants to use at trial.
Pauldine’s attorney sought to have the accusatory instrument against his client dismissed on grounds of insufficiency.
He also moved to have evidence suppressed on the grounds that it was obtained without probable cause.
The judge denied both requests, Todd said.
