Judge Denies Thibodeau Motion for New Trial

OSWEGO – An effort to get a new trial for Gary Thibodeau has reportedly been denied.

In 1995, Thibodeau was convicted of first-degree kidnapping for kidnapping Heidi Allen on Easter in 1994. She is still missing.

Thibodeau is serving 25 years to life in prison for Allen’s kidnapping.

His defense argued that he should be granted a new trial because new evidence implicated three other men in Allen’s disappearance.

“The evidence presented is too remote and disconnected to show that someone other than the defendant kidnapped Heidi Allen,” the court ruled.

In a statement to the media, Oswego County District Attorney Greg Oakes said, “The court’s decision is well reasoned and is supported by the law and the evidence. While I’m pleased with the decision, there’s no cause for celebration. Heidi is still missing, and her family is no closer to having her. I hope that Gary Thibodeau finds it in his heart to acknowledge his crime so that Heidi’s family can have some measure of peace.”

  1. As expected…can’t give him a new trial due to the possibility, albeit remote, he might be acquitted & end up suing this county into oblivion; if he’s so guilty then there shouldn’t be any trouble re-convicting him again right? Don’t worry about saving the taxpayers’ monies re-trying him, no one worries about saving it on any other issues & this is one I wouldn’t mind paying for just to see where it would end up, the suspense it seems will forever kill me at this point. Hmmmm…..
