Multiple Arrests Made in Oswego Assault Case

OSWEGO – On June 8, at 5 p.m., Luis A Dailey (7/23/90) of 315 Lyman Ave., Fulton, was arrested and charged with Gang Assault in the Second Degree, a violation of NYS Penal Law 120.06, a Class C Felony.

Dailey was arraigned in Oswego City Court and remanded to the Oswego County Justice Center on $10,000 cash or $20,000 bond, with a return date of 06/21/17 at 9:30 a.m. in Oswego City Court.

On June 16, at 7:57 a.m., Kevin J Vandelinder (12/18/85) of 210 Academy St., Fulton, was arrested and charged with Gang Assault in the Second Degree, a violation of NYS Penal Law 120.06, a Class C Felony.

Vandelinder was arraigned in Oswego City Court and remanded to the Oswego County Justice Center with no bail and a return date of 6/27/17 at 9:30 a.m. in Oswego City Court.

On June 16, at 10:15 a.m. a 17-year-old boy (information not being released due to age, according to police) was arrested and charged with Gang Assault in the Second Degree, a violation of NYS Penal Law 120.06, a Class C Felony.

Said defendant was arraigned in Oswego City Court and released on his own recognizance with a return date of 7/25/17 at 9:30 a.m. in Oswego City Court.

Note: NYS Penal Law 120.06: A person is guilty of gang assault in the second degree when, with intent to cause physical injury to another person and when aided by two or more other persons actually present, he causes serious physical injury to such person or to a third person. Gang assault in the second degree is a class C felony.

It is alleged that on June 3, at 11:15 p.m. multiple individuals were involved in a physical altercation in the area of West First Street near West Utica Street in the city of Oswego.

A preliminary investigation determined that, as a result of this physical altercation, an adult male victim was injured and suffered a stab wound to his torso. The victim was transported to Upstate Medical Center, Syracuse, treated, and eventually released.

Through the investigation, it is further alleged that multiple suspects did act in concert and repeatedly punch and kick the victim, strike the victim in the head with a beer bottle and stab the victim with a sharp metal object.

The above three arrests have been made in the case so far.

Assisting the Oswego City Police Department in the arrests of the subjects were members of the Oswego County Sheriff’s Department, Fulton City Police Department and New York State Parole.

The investigation remains ongoing, with more charges and possible additional arrests pending.
