Sheriff’s Dep’t: 2009 Child Porn Case Ends With Sentencing in England

On December 27, 2009 members of the Oswego County Sheriff’s Office were sent to a Town of Granby residence to check the welfare of a resident. Upon investigation of the complaint it was determined that a 14 year old female was found to be in possession of several pornographic videos depicting two children less than the ages of 3 involved in sex acts. Additional investigation by The Sheriff’s Office Road Patrol Division revealed that the videos had been produced by the 14 year old female using a cellular phone.

Subsequent cellular phone and computer forensic investigations conducted by the Oswego County Sheriff’s Office Criminal Investigation Division determined that the videos had been transmitted using a cellular phone to a 17 year old male from Coventry area in the United Kingdom.

On January 20, 2010 the 14 year old female was charged as a Juvenile Delinquent with the following acts, which if committed by an adult, would constitute the crimes of Criminal Sex Act, First Degree, a class B-Felony; Sex Abuse, First Degree, a class D-Felony; Possession of a Sexual Performance by a Child, a class E-Felony; and Endangering the Welfare of a Child, a class A misdemeanor.

During the month of February, 2010, contact was made with members of the West Midland Police Child Exploitation Investigation and Child Online Safeguarding Units located in the United Kingdom. All case investigation paperwork was forwarded to them for additional follow-up investigation involving the 17 year old male. Acting on the information provided by the Oswego County Sheriff’s office Criminal Investigation Division the West Midland Police executed search warrants on the 17 year old male recovering additional evidence from his computers and mobile phone.

The 17 year old male was consequently charged with eight counts of Making Indecent Images, two counts of Arranging or Facilitating Commission of a Child Sex Offense, three counts of Causing or Inciting a Child to Engage in Sexual Activity, one count of Production of Child Pornography, and one count of Possession of Extreme Pornography.

On January 19, 2011 the now 18 year old male from the Wood End area of Coventry in the United Kingdom, was sentenced at Coventry Crown Court. The sentencing involved an indefinite Hospital Order with restrictions, which will mean he is kept in a secure hospital and will only be released when he is no longer considered to be a threat to the public. He was also placed on the Sex Offender Register for life and was handed a Sexual Offences Prevention Order (SOPO), which allows the police to place restrictions on him and monitor his movements.

As quoted from West Midlands Police Media and Communications: Detective Inspector Kay Wallace, head of the Child Online Safeguarding Team, said: “The Defendant posed a great threat to young people and this sentencing will go a long way to protecting young and vulnerable children in the future, on both sides of the Atlantic…We worked closely with police in America to bring this dangerous offender to justice. The assistance and valuable information provided by the American authorities allowed us to stop the defendant from committing these horrific crimes.”
