OSWEGO, NY – At Monday night’s Common Council meeting, the mayor was authorized to execute an Order of Consent/Stipulation with the New York State Department of Conservation.
The city has been cited by the DEC for “the making or use of an outlet or point source discharging into the waters of the state without a valid SPDES Permit and for operation and maintenance violations at the West Side Wastewater Treatment Plant.”
In satisfaction of the stipulation, the city will pay $10,000. The city also agreed to other stipulations including submitting a revised operation and maintenance schedule of the plant.
Earlier this year, the EPA and DEC commenced an enforcement proceeding against the city with respect to alleged violations of the Federal Clean Water Act resulting from unpermitted overflows from the city’s sanitary and combined sewer systems.
Through its representatives, the city negotiated a settlement with the EPA and DEC.
The city has a schedule of corrective work starting this year going all the way out to 2022.
In other action, councilors breezed through the short agenda in less than 10 minutes.
The council set a public hearing on the 2020 Vision Comprehensive Plan Revision document for 7 p.m. on Dec. 13.
And, a public hearing for 7:10 p.m. Dec. 13 regarding the proposed Local Law #2, amending Chapter 63, Animals.
On June 22, Gov. Paterson signed a measure into law as part of the 2011 state budget that significantly amends Article 7 of the Agriculture and Markets Law regarding the licensing of dogs in New York State.
One major change is that the licensing will now be a local government function, effective Jan. 1, 2011.
As a result, the city has to revise its code to conform to the new regulations.
The council also approved use of public space for Thomas J. Kells, owner of a multiple-family dwelling at 51 E. Fourth St.
He requested use of public space in order to utilize an existing 10’ X 71’ paved parking area for three cars, fronting on East Fourth Street as well as utilize an existing 12’ X 43’ paved parking area for two cars, fronting on East Cayuga Street.
Councilors accepted two donations. One from Jeanne Cooper of a used computer including monitor, keyboard, mouse and printer for use by the DPW; the other a donation of a quantity of used dog kennel gates from Marie Schadt of K-9 Groomers for use at the animal shelter.
The purchasing agent was authorized to seek bids for two new 10-wheel plow trucks for use by the DPW.
Funding will come from the New York State Regional Economic Grant recently awarded to the city.
The mayor was authorized to sign a one-year renewal agreement with Butler Disposal Systems for the pick up and disposal of trash and recyclable materials from city-owned facilities.
Tony Leotta, city engineer, was authorized to transfer $7,500 from Account G8140.0420 (Utilities) West Side Wastewater into Account G8140.0102 (Personal Services Overtime) West Side Wastewater.
The city clerk was authorized to transfer $2,800 from the General Fund Contingency Account A1990.0460 into the City Clerk’s Equipment Account A1410.0200 for the purchase of and delivery of a fire-proof safe to maintain historical records.
The council resolved to amend Resolution No. 417 of 2010 regarding a change order with W.D. Malone Trucking and Excavating for project modifications to the Catch Basin Removal Project.
The total contract authorization had been incorrectly stated.
Councilors OK’d the new figure, $445,191.15.
